US: AG sues CDPHP for delaying hepatitis C coverage

Health insurer CDPHP has been accused by state Attorney General Eric Schneiderman of breaking the law by delaying coverage for hepatitis C treatments until patients are in the advanced stages of the potentially life-threatening disease.

The Attorney General’s office filed a lawsuit Thursday in state Supreme Court in New York County, contending the Albany-based company failed to cover medically necessary care and deceived members about their coverage.

CDPHP members diagnosed with early-stage chronic hepatitis C infection must monitor their disease and wait until they develop liver scarring or other advanced symptoms before their treatment will be covered, Schneiderman’s office said.

“Forcing patients to wait for care, risking internal organ damage, is unconscionable and, as we allege in our lawsuit, violates the law and the company’s own policies,” Schneiderman said.
